Welcome to Mochitoes. These Terms of Service (“Terms”) govern your use of our online store and any purchase you make from us. By using our store or placing an order, you agree to these Terms. If you do not agree, please do not use the store.
1. Who we are

2. Eligibility
You must be at least the age of majority in your state or country of residence, or have the permission of a parent or guardian, to place an order. You agree to provide accurate and complete information when you order.
3. Products
We make every effort to display our products, styles and colors as accurately as possible. Because each screen displays colors differently, small variations in color, size or details may occur. Product images are for illustration purposes. Please read our Safety & Care instructions before using your Mochitoes™.
4. Prices and promotions
- All prices are shown in US dollars (USD) unless your checkout shows another currency.
- Bundle prices (Couple and Family) and other promotions are applied automatically in your cart and at checkout, and are valid while the offer is shown on the store.
- We may change prices or end promotions at any time. Changes do not affect orders already placed.
- If a product is listed at an incorrect price because of an obvious error, we may cancel the order and refund you in full, even after you receive an order confirmation.
5. Orders
Your order is an offer to buy. After you place it, you will receive an order confirmation email; the contract is formed when we confirm or ship your order. We may refuse or cancel an order (for example, because of suspected fraud, a pricing error or unavailable stock). If we cancel an order you have paid for, we will refund you in full.
6. Payment
Payments are processed securely by Shopify and its payment partners. We do not see or store your full card details. By submitting payment, you confirm that you are authorized to use the payment method.
7. Taxes
Where required by law, applicable sales taxes will be calculated and shown at checkout. Orders shipped outside the United States may be subject to import duties and taxes in the destination country.
8. Shipping and delivery
Shipping times and conditions are described in our Shipping Policy. Delivery estimates are not guaranteed. Risk of loss passes to you when the order is delivered to the shipping address you provided.
9. Returns and refunds
Returns and refunds, including our 30-Day Money-Back Guarantee, are governed by our Refund & Return Policy.
10. Use of our products
You agree to use our products as intended and according to the Safety & Care instructions. Our products are not medical devices and are not intended to diagnose, treat, cure or prevent any disease or condition.
11. Intellectual property
The Mochitoes name and logo, Mochitoes™, and all content on this store (including text, images, graphics and design) belong to us or our licensors and are protected by intellectual property laws. You may not copy, reproduce or use them for commercial purposes without our written permission.
12. Reviews and comments
If you submit a review, comment or other content, you confirm that it is honest, reflects your real experience and does not infringe anyone’s rights. You grant us a non-exclusive, royalty-free license to use, reproduce and display that content in connection with our store. We may remove content that is unlawful, offensive or misleading.
13. Prohibited uses
You may not use the store for any unlawful purpose, to interfere with its security or operation, to submit false information or fraudulent orders, or to collect information about other users.
14. Third-party services and links
Our store may contain links to, or rely on, third-party services (such as payment providers and carriers). We are not responsible for the content or practices of third-party websites and services.
15. Disclaimer
To the fullest extent permitted by law, our store and its content are provided “as is” and “as available”. We do not guarantee that the store will be uninterrupted or error-free. Nothing in these Terms excludes any warranty or right that cannot be excluded under applicable consumer law.
16. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages arising from your use of the store or our products, and our total liability for any claim relating to an order is limited to the amount you paid for that order. Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be limited or excluded by law.
17. Indemnification
You agree to indemnify and hold us harmless from any claim arising out of your breach of these Terms or your misuse of the store or our products.
18. Governing law and disputes
These Terms are governed by the laws of Spain, without prejudice to any mandatory consumer protection laws of your country or state of residence that give you greater protection. If you have a problem, please contact us first at mochitoees@gmail.com; most issues can be solved quickly and informally. If we cannot resolve it, you may bring a claim before the competent courts determined by applicable law.
19. Changes to these Terms
We may update these Terms from time to time. The version published on the store at the time of your order applies to that order.
20. General
If any provision of these Terms is found to be invalid, the remaining provisions remain in full force. Our failure to enforce any right does not waive it. These Terms, together with the policies referred to above, form the entire agreement between you and us regarding your use of the store.
